These Terms and Conditions ( “Terms” or “Terms and Conditions”) govern your (“you” or “your”) access to and use of the Lotiwellness.com web site (the “Website”) and all services provided by Loti Wellness via the Website including without limitation our product(s) and gift service (collectively, the “Services”).   Loti Wellness provides a subscription service for therapeutic activities and wellness-inspired items. Access to the Website, use of the Services, and purchase of the Products is subject to these Terms and Conditions and the Loti Wellness Privacy Policy available on the Website at the following link: Privacy Policy. These Terms apply to all users of the site, including without limitation, users who are browsers, vendors, customers, merchants, actual and/or potential brand ambassadors, and/or contributors of content. If these Terms are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service.  

Acceptance of Terms By using our Website or subscribing to our Services, you indicate your unconditional acceptance of the following Terms and Conditions. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change, or replace any and all portions of these Terms by posting updates and/or modifications to our website. It is your responsibility to check this page periodically for changes. Any such modifications shall be effective immediately. Your continued use or access to the website following the posting of any changes constitutes acceptance of those conditions.  

Scope of Service Loti Wellness maintains this Website as a service to the user community that visits the Website subject to these Terms and Conditions. You are responsible for obtaining any equipment and Internet service necessary to access our Website and for paying any fees for the equipment and service you select. We may alter, suspend, or discontinue this Website or the Services in whole or in part, at any time and for any reason, without notice. The Website may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons.  

Website Content Users have a personal, non-transferable, non-exclusive right to access and use the Content of this Website subject to these Terms and Conditions. The term “Content” means all information, text, images, data, links, software, or other material accessible through the Website or Services, whether created by us or provided by another person for display on the Website or through the Services. Social Media Content Policy In addition to any rights we may have in Your Content or Comments, by posting content, including but not limited to photographs, videos, comments, and your applicable social media handle to Loti Wellness-labeled social media, posting such content to your social media accounts using the tag #liveloti, #lotiwellness, or otherwise associating such content with the tag #liveloti, #lotiwellness, or other hashtags sponsored or affiliated with Loti Wellness (“Social Media Content”), you grant Loti Wellness and any of its third-party content management providers (collectively, the “Licensing Parties”) a perpetual, irrevocable, royalty-free, non-exclusive, transferable, sublicensable right and license to display, copy, publish, distribute, transmit, print, create derivative works from, alter, edit and/or use your Social Media Content in any manner to be determined in Loti Wellness’s sole discretion, including but not limited to on webpages and social media channels operated by Loti Wellness, and for other marketing and promotional purposes, in any media now or hereafter known, with no obligation to you whatsoever. To the extent your social media username, real name, image, appearance, voice, likeness, caption, location or other identifying information (“Identifying Information”) are included as part of your Social Media Content, you hereby grant the Licensing Parties the right and license to use such Identifying Information in connection with any use of your Social Media Content. We will make commercially reasonable efforts to credit you for any such Social Media Content by posting your handle or byline, however we make no assurance to do so and you agree that we are not required to do so. When you use the hashtag #liveloti, #lotiwellness, or other hashtags sponsored or affiliated with Loti Wellness, you represent and warrant that (i) you own all rights in and to your Social Media Content, or are not aware of any third-party rights that must be obtained to grant the Licensing Parties the rights provided herein; (ii) all person(s) appearing in your Social Media Content have granted permission for the uses and rights described herein; (iii) you are of legal age to consent to this agreement; and (iv) you are not aware of any reason why the use of your Social Media Content by the Licensing Parties as described herein will violate the rights of any third party or any law. You agree you will not post or encourage others to post Social Media Content that is unlawful, harassing, defamatory, obscene, libelous, or otherwise objectionable. 

Ownership Except with respect to Your Content, you acknowledge and agree that, as between you and Loti Wellness, Loti Wellness owns all rights, title and interest (including all intellectual property rights) in the Service and all Content and other materials within the Service. The Service is protected by Canadian and international copyright, trademark, patent and other intellectual property laws and treaties. Either reserve all rights not expressly granted to you. 

Registration and Membership; Product Sales In order to start your ongoing Loti Wellness subscription, you must register as a member on our Website. To register you can simply provide your shipping information including your address and billing information, and your valid email address and password to create your login profile. For your convenience as a Loti Wellness member, all information that you provide to Loti Wellness is subject to Loti Wellness’s Privacy Policy. You are responsible for keeping your registration information up to date through the account page on the Website. As a registered user of Loti Wellness, you agree to receive emails promoting any special offer(s), including third-party offers. We may from time to time send you billing reminders, shipping notices and newsletters. You may opt-out from receiving our emails by emailing [email protected] or selecting to unsubscribe as may be provided in the applicable e-mail correspondence.

Subscription Policy; Automatic Renewal Members subscribing before the 10th of the month will receive that month’s box, otherwise if signing up after the 10th they will receive the following month’s box. We will ship you a package with a different selection of items from various wellness and lifestyle brands. Each cycle of your subscription, the selection of Products may change. Accordingly, Loti Wellness cannot guarantee that a selection available in a particular timeframe will be available in any subsequent timeframe. Boxes will be shipped to your address at the price listed. You may receive emails regarding your account or promotions for special offers, including third party offers. You may change your email preferences or cancel your membership at any time by emailing us at [email protected]. CONTINUOUS SUBSCRIPTION AND AUTOMATIC RENEWAL TERMS: BY SUBSCRIBING, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT (1) LOTI WELLNESS (OR ANY THIRD-PARTY PAYMENT PROCESSOR) IS AUTHORIZED TO CHARGE YOU ON A RECURRING BASIS AT THE THEN-CURRENT SUBSCRIPTION RATE (IN ADDITION TO ANY APPLICABLE TAXES AND OTHER CHARGES) FOR AS LONG AS YOUR SUBSCRIPTION CONTINUES WITHOUT FURTHER AUTHORIZATION FROM YOU, AND (2) YOUR SUBSCRIPTION WILL BE AUTOMATICALLY RENEWED FOR SUCCESSIVE PERIODS UNTIL YOU CANCEL YOUR SUBSCRIPTION. LOTI WELLNESS MAY SUBMIT PERIODIC CHARGES (E.G., MONTHLY) WITHOUT FURTHER AUTHORIZATION FROM YOU, UNTIL YOU PROVIDE PRIOR NOTICE THAT YOU HAVE TERMINATED THIS AUTHORIZATION OR WISH TO CHANGE YOUR PAYMENT METHOD WITHIN THE 24-HOUR NOTICE REQUIREMENT. WE RESERVE THE RIGHT TO REVOKE YOUR SUBSCRIPTION AT ANY TIME. MEMBERSHIP IS VOID WHERE PROHIBITED BY LAW.

BY PURCHASING ANY SUBSCRIPTION OR PRODUCT, YOU AGREE TO NOT HOLD LOTI WELLNESS LIABLE FOR ANY HARM OR DAMAGES RELATED TO THE PURCHASE OR USE OF GOODS, SERVICES, RESOURCES, OR CONTENT.

Modifications to The Service and Prices Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Products or Services Certain products or services may be available exclusively online through the website. These products or services may have limited quantities. We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of Loti Wellness. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Accuracy of Billing and Account Information We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.  

Third-Party Products and Services Certain products and services available via our Service may include materials from third parties. We are not responsible for examining or evaluating the content from third parties. We disclaim all warranties of any kind, including but not limited to any express warranties, statutory warranties, and any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the extent that your jurisdiction does not allow warranty disclaimers or limitations on warranty, such limitations shall be to the greatest extent possible under the current law in your jurisdiction. You agree to hold Loti Wellness harmless from any liability or responsibility for third-party materials, products, or services or any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.  

Cancellation Policy If you are not completely satisfied with Loti Wellness, you can cancel your membership and discontinue your recurring payments at any time. In order to cancel before you are re-billed for the next shipment, you need to contact Loti Wellness at [email protected] AT LEAST 24 HOURS PRIOR TO YOUR NEXT SCHEDULED RENEWAL DATE (10^th of each month). If your membership has already renewed and you’d like to cancel an upcoming shipment, you must request cancellation by the 24th of the month to be eligible for a refund.  

If you have committed for a longer subscription and have boxes left to receive you will be charged for, and will be shipped the remaining boxes. Then upon completion of your original commitment your subscription will automatically be cancelled. E.G If you sign up for a 12 month subscription and have paid for 8 boxes you will be charged for another 4 before your subscription finishes. This does not initiate any kind of refund if you fail to cancel before the renewal date.

Your subscription is continuous until you cancel and, if you cancel your membership before the end of an existing subscription commitment period, you will be charged for the remainder of that subscription period. 

By Loti Wellness stating you can cancel at anytime this directly refers to the renewal at the end of a commitment term and not the original commitment term itself.

Any discounts given on the first month of a new subscription are applied on the assumption you stay subscribed for the entire initial commitment period. If you request to cancel before the end of the initial commitment you no longer qualify for any discount on any boxes and must pay the one month rate for any box you received a discount on.

We may, in our sole discretion, approve a cancellation before the end of the initial commitment period, but you agree to a cancellation fee of $55.99 CAD + tax.

Return Policy If you are unsatisfied with your box, we are happy to accept returns for recurring subscriptions. Multi-month gift options are offered at a discount because of the upfront commitment, and are non-refundable. We accept a return of your Loti Wellness Box in exchange for store credit/refund if you email us and ship back your box within 14 days of receiving your box.

1. Loti Wellness Boxes must be brand new in original/unopened condition with full contents and original/new packaging.

2. The box must be wrapped in an outer poly bag, or another box. Any box without protective packaging, or has missing contents will not be accepted for returns.

3. Refunds will be credited in the manner in which payment was made.

4. US orders: Once your return request is approved, please send your box using USPS.

5. Shipping charges are non-refundable for all purchases made online.

6. Customer is responsible for shipping and customs fees incurred in the return process. We do not provide store credit for returned products that are opened, used, returned after 14 days, damaged due to misuse, lack of care, mishandling, accident, abuse, or other abnormal use. We are not liable for products that are damaged or lost in transit back to us, therefore please ensure the Loti Wellness Box is packaged securely when being returned.

Billing and Payments All information that you provide to register with Loti Wellness including your credit card information is subject to Loti Wellness ‘s Privacy Policy. The price of the Services and/or goods is payable in full before delivery. We accept the following credit cards at this time: Visa, MasterCard. For your convenience and continuous subscription benefits as a member, if your payment method reaches its expiration date and you do not edit your credit card information or cancel your account, you authorize us to continue billing that credit card on file including extending the expiration date until we are notified by you or the credit card company that the account is no longer valid. We encourage you to update your payment method information or cancel your account should you wish to discontinue your recurring purchase of Products. We use a third-party payment service in lieu of directly processing your credit card information. By submitting your credit card information, you grant Loti Wellness the right to store and process your information with the third-party payment service, which it may change from time to time; you agree that Loti Wellness will not be responsible for any failures of the third-party to adequately protect such information. All financial matters regarding your information are subject to the conditions of the third-party payment service provider’s terms of service; the current versions is attached as a link at https://www.braintreepayments.com/legal. You acknowledge that we may change the third-party payment service and move your information to other service providers that encrypt your information using secure socket layer technology (SSL) or other comparable security technology.  

Shipping and Risk of Loss Any merchandise purchased from our Site will be shipped by a third-party carrier. As a result, title and risk of loss or damage for such merchandise will pass to you upon our delivery to the carrier. All missing or damaged shipments or items must be reported by emailing support at [email protected] within 14 days of shipping to qualify for a replacement or refund based on product availability. If the product is available, a replacement will be shipped and a refund will not be issued or considered. Shipping dates and/or arrival times are only estimates. Replacement of Products and credits to your account for shipped merchandise claimed as not received are subject to our investigation, which may include postal-service notification. We will adjust your account at our discretion. Blemishes to packaging will not be considered as part of a damaged item. All refunds will be at the discretion of customer support. Repeated claims of undelivered merchandise may result in the cancellation of your membership. Refunds will only be made to the original payment method specified at purchase. Please note that in the case of international shipping, the recipient will be responsible for any and all customs fees and duties charged.  

Local Taxes You may be charged local sales tax, GST/PST, HST, or VAT, if applicable.  

International Access This Website may be accessed from countries other than Canada. This Website and the Services may contain products or references to products that are only available within Canada. Any such references do not imply that such products will be made available outside Canada. Indemnification By using this Website, our Services, or supplied Products, you agree to indemnify, hold harmless and defend Loti Wellness from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to, attorneys’ fees, resulting directly or indirectly from a claim by a third party that arises in connection with use of this Website, Services, or Products by you or any other person accessing the Website using your member login account.  

Content Submitted by Users Accuracy You may use this Website (but not subscribe to our Services) without volunteering personally identifiable information.
